RESUMO 

Este relatório técnico compreende análise dos aspectos legais relacionados à concessão dos serviços públicos de destinação final ambientalmente adequada dos resíduos sólidos urbanos, compreendendo atividades operacionais de triagem, transbordo e tratamento, incluindo a compostagem, por intermédio da instalação, operação e manutenção de Unidade de Tratamento Mecânico Biológico (UTMB) no Distrito Federal. Foram examinados os marcos regulatórios aplicáveis à matéria, com destaque para as Política Nacional e Distrital de Resíduos Sólidos, o Plano Distrital de Gestão Integrada de Resíduos Sólidos, regulamentos referentes a combustível derivado de resíduos sólidos urbanos, biogás/biometano e/ou energia elétrica/térmica, bem como as normas disciplinadoras de concessões de serviços públicos. O estudo aborda a possível modelagem jurídica para a concessão, observando a recente Lei nº 14.026, de 2020, que atualiza o marco legal do saneamento, e as disposições de instrumentos legais e normativos distritais. 

ABSTRACT

This technical report makes the legal analysis of the feasibility of the concession for the installation, operation and maintenance of a Mechanical Biological Treatment Unit (MBTU) in the Federal District, which comprises a set of activities, infrastructures and operational facilities aimed at the environmentally appropriate final disposal of municipal solid waste through a contemporary system of reception and sorting of these residues, reconciling the recovery of recyclable materials that compose the dry fraction, the production of fuel derived from municipal solid waste, and the biological treatment of organic waste in processes such as anaerobic digestion and/or composting, with the production of stabilized organic material, biogas/biomethane and/or electric / thermal energy, among other possible technologies, depending on its technical and economicfinancial viability. The regulatory frameworks applicable to the matter were examined, with emphasis on the National and Federal District Solid Waste Policy, the Federal District Plan for Integrated Solid Waste Management, regulations regarding fuel derived from solid urban waste, biogas / biomethane and / or electric energy / as well as the disciplinary rules for public service concessions. The study addresses the possible legal modeling for the concession, observing the recent Law No. 14,026/2020, which updates the legal framework for sanitation, and the provisions of Federal District legal and regulatory instruments.
